Meetings of the Working Group on Labor Legislation Issues of the KAZENERGY Association

On August 2, 2018 at the site of the KAZENERGY Association was held the meeting of the Working Group on labor legislation of the KAZENERGY Association (hereinafter referred as the Working Group).

The KAZENERGY Association members and the invited representative of Ernst & Young Kazakhstan LLP took part in the meeting of the Working Group.

The following issues were discussed: The Concept of the Draft Law of the Republic of Kazakhstan “On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Labor Issues” regarding the procedure for processing materials for investigating accidents related to the labor activity; the shift work method with the summation of working hours and paid annual work leave during rotational leave; the new norm on the verification of the authenticity of documents submitted by employees for the passage of the preliminary compulsory medical examination within the framework of Article 23 “Basic Rights and Obligations of the Employer”; one of the cases of the employment contract termination on the employer initiative with regard to the exclusion or acceptance of the term “early” termination of the powers of the head of the executive body, the members of the collegial executive body of the legal entity, or the authority of an individual member of the executive body; consideration of the inclusion of the term “gas distribution systems” in paragraph 2 of Article 130 and other issues related to labor legislation.

This work will be continued within the framework of the Expert Group on Analysis of Law Enforcement Practice of Labor Legislation under the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan with the participation of the Federation of Trade Unions of the Republic of Kazakhstan, the government bodies and the interested members of the Association.
